Security Deposits in Virginia:
A Guide for Owners and Residents

Security deposits in Virginia are governed primarily by the Virginia Residential Landlord and Tenant Act (VRLTA), Va. Code § 55.1-1226, together with the move-in inspection rules in § 55.1-1214 and the definitions in § 55.1-1200.

A security deposit is not a fee. It is the tenant's refundable money, held to secure performance of the lease and cover lawful charges when the tenancy ends.

Peabody Residential manages residential rentals throughout Northern Virginia, and our approach to security deposits is simple:

  • Comply strictly with Virginia law.
  • Document everything thoroughly.
  • Deduct only what the law allows, what we can document, and what is charged in good faith.
